TERMS AND CONDITIONS
1. THE PROMOTER
The promoter is Canon Europa N.V., registered at Bovenkerkerweg 59, 1185 XB, Amstelveen, the Netherlands (“Canon”).
2. ABOUT PROMOTION
2.1. Participants
2.1.1. All Participants must be aged 18 or over.
Distributors and retailers are excluded from the promotion and shall not be eligible to participate on behalf of their customers.
2.1.2 All Participants are deemed to have agreed to be bound by these Terms and Conditions.
2.2. Promotional Products, Territory and Periods
2.2.1 This promotion is only available on purchases made of the EOS-1D X Mark II (“Promotional Product”).
2.2.2 To qualify for the promotion the Participant must purchase the Promotional product between the 01.03.2017 and 30.06.2017.
2.2.3 All Promotional Products must be purchased from retailers located within Denmark, Estonia, Latvia, Lithuania, Finland, Norway, Sweden or from an Internet store with a domain or a registered address in any of the countries listed above (the “Promotional Territory”).
2.2.4 Participant can claim a SanDisk 64GB Extreme PRO® CFast™ 2.0 Memory Card
and Card Reader on up to 10 promotional products purchased. This offer cannot be combined with any other offer.
Claims by business or individuals who make bulk purchases (being more than 10 Promotional Products during the Promotional Period) will NOT be eligible to enter this promotion.
2.2.5 All Promotional Products must be new and genuine Canon products. Purchases of second hand, refurbished or reconditioned products, or products which are counterfeit or infringe the intellectual property rights of the Canon group companies in any way will not qualify under this promotion.
2.2.6 All the Promotional Products must have been supplied and distributed by Canon Europa N.V. or Canon group companies located in the EEA, Switzerland or Lichtenstein. Please always check with your retailer to avoid disappointments. To learn more about this, please check the link: [GREY MARKET]
2.2.7 Promotional Product returned (free of default) to the seller shall not be valid for the promotion and Participants found claiming for these products shall not be eligible. If Canon becomes aware of any such fraud, it shall be free to take a legal action against any Participants involved.
3. How to Participate
3.1. To participate in the promotion, the Participant must purchase the Promotional Product EOS-1D X Mark II between the 01.03.2017 and the 30.06.2017.
3.2 The gift (1x SanDisk 64GB Extreme PRO® CFast™ 2.0 Memory Card + 1x Reader/Writer) will be delivered to the buyer together with the purchase of the camera on the same invoice.
SanDisk warrants to the end user, that this product, excluding content and or software supplied with or on the product, will be free from material defects in manufacture, will conform to SanDisk's published product specifications and be fit for normal use during the Warranty Period specified in the table commencing on the date of purchase provided that the product is legally placed on the market.
Canon shall have no liability or responsibility whatsoever and howsoever arising in connection with the use, non-use or defect of the SanDisk 64GB Extreme PRO® CFast™ 2.0 Memory Card and/or the Card Reader.
4. DISCLAIMERS
4.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. However, nothing in these terms and conditions shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.
4.2. Canon reserves the right to void, amend, and/or change this promotion at any time without incurring any liability whatsoever but will always endeavor to minimize the effect to the Participant in order to avoid undue disappointment.
4.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the promotion is being abused in any way.
Canon’s decisions in relation to the promotion are final and no correspondence
will be entered into.
5. DATA
5.1 Canon Europa N.V. and Canon Europe Limited registered in United Kingdom under a registration number 4093977 having a place of business at 3 The Square, Stockley Park, Uxbridge UB11 1ET, United Kingdom are the Data Controllers for the purposes of applicable personal data protection laws and regulations in respect of any personal data supplied by Participants in relation to this promotion. All personal data will be processed by Canon Europa N.V. and/or its group companies solely for the purpose of administering this promotion including supplying the information to third parties appointed to administer the promotion and/or for any authorized marketing purposes. If Participants do not wish for their contact information to be used for marketing purposes or to enable Canon to contact them in future regarding similar promotions, they should NOT check the relevant “opt-in” box when completing the claim form.
6. LAW AND JURISDICTION
To the extent permitted by law, these terms and conditions and any disputes arising out of or in connection with them and this promotion shall be governed by and construed in accordance with the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
As a consumer, you may be entitled to bringing court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you of your rights. These terms and Conditions do not restrict your statutory rights.
